AROHA WELLINGTON – Terms & Conditions
Article 1 – Definitions
In these Terms & Conditions, the following definitions apply:
Cooling-off period: The period during which the consumer may exercise their right of withdrawal.
Consumer: Any natural person who is not acting for purposes related to trade, business, craft, or profession and enters into a distance contract with AROHA WELLINGTON.
Day: Calendar day.
Extended transaction: A distance contract relating to a series of products and/or services, where delivery and/or purchase obligations are spread over time.
Durable medium: Any tool that enables the consumer or AROHA WELLINGTON to store information addressed personally to them in a way that allows future consultation and unchanged reproduction.
Right of withdrawal: The consumer’s right to cancel the distance contract within the cooling-off period.
Entrepreneur: AROHA WELLINGTON, the natural or legal person offering products and/or services remotely to consumers.
Distance contract: A contract concluded exclusively through one or more means of remote communication within an organized distance-selling system.
Means of remote communication: Any method used to conclude an agreement without consumer and entrepreneur being physically present together.
Terms & Conditions: These General Terms & Conditions of AROHA WELLINGTON.
Article 2 – Right of Withdrawal
Consumers have the right to withdraw from their purchase within 30 days without giving any reason.
During this period, consumers must handle the product and packaging with care. If the right of withdrawal is exercised, the product must be returned with all supplied accessories and, where reasonably possible, in its original condition and packaging, following AROHA WELLINGTON’s return instructions.
Article 3 – Applicability
These Terms & Conditions apply to every offer made by AROHA WELLINGTON and to every distance contract concluded between AROHA WELLINGTON and the consumer.
Before a distance contract is concluded, these Terms & Conditions will be made available to the consumer. Where this is not reasonably possible, AROHA WELLINGTON will indicate where the Terms & Conditions can be reviewed and will provide them free of charge upon request.
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force.
Situations not covered by these Terms & Conditions shall be interpreted in accordance with the spirit of these Terms & Conditions.
Article 4 – The Offer
All offers made by AROHA WELLINGTON are non-binding and may be changed or adjusted.
AROHA WELLINGTON aims to provide accurate product descriptions, images, and specifications. However:
- Images are for illustrative purposes only
- Minor color differences may occur due to screen settings
- Obvious errors or mistakes do not bind AROHA WELLINGTON
Each offer will clearly state:
- Product pricing
- Shipping costs
- Payment methods
- Delivery details
- Right of withdrawal applicability
Article 5 – The Agreement
A purchase agreement is concluded when the consumer accepts the offer and fulfills the stated conditions.
AROHA WELLINGTON will confirm orders electronically upon receipt.
AROHA WELLINGTON reserves the right to refuse or cancel orders where justified, including suspected fraud, payment issues, or stock unavailability.
Article 6 – 30-Day Return Policy
Consumers may return eligible products within 30 days of receipt.
Conditions:
- Return request must be submitted within 30 days via written notice or email
- Items must be returned within 30 days after notification
- Products must be unused where reasonably possible, with original packaging
Failure to notify or return within the specified period confirms the purchase.
Article 7 – Return Costs & Refunds
Return shipping costs are the responsibility of the consumer unless otherwise stated.
AROHA WELLINGTON will refund eligible payments within 30 days after receiving the returned product or valid proof of return shipment.
Article 8 – Exclusions from Returns
The right of withdrawal may be excluded for:
- Custom-made or personalized products
- Hygiene-sensitive products with broken seals
- Products unsuitable for return due to their nature
- Time-sensitive or perishable items
Any exclusions will be clearly stated before purchase.
Article 9 – Pricing
All prices listed by AROHA WELLINGTON are subject to:
- Typographical errors
- Currency fluctuations
- Tax or legal changes
AROHA WELLINGTON is not obligated to honor clearly incorrect pricing due to obvious mistakes.
Article 10 – Product Conformity & Warranty
AROHA WELLINGTON guarantees that products conform to the agreement, product description, and reasonable quality standards.
Consumers must report defects or incorrect deliveries within 30 days of receipt.
Warranty does not apply where:
- Products are altered or repaired by unauthorized parties
- Damage results from misuse, negligence, or improper care
Article 11 – Delivery & Fulfillment
AROHA WELLINGTON will process accepted orders with care and aims to deliver within 30 days, unless otherwise agreed.
If delivery is delayed or impossible:
- Consumers will be informed promptly
- Consumers may cancel without penalty
- Refunds will be issued where applicable
Risk transfers to the consumer upon delivery.
Article 12 – Payment
Unless otherwise agreed, payment must be completed according to the selected payment method at checkout.
Consumers must immediately report payment inaccuracies.
In cases of non-payment, AROHA WELLINGTON may apply reasonable recovery costs where legally permitted.
Article 13 – Complaints Procedure
Complaints regarding products or services must be submitted clearly to AROHA WELLINGTON within 7 days of discovering the issue.
AROHA WELLINGTON aims to respond within 14 days.
If a complaint requires longer handling, acknowledgment and expected resolution timing will be provided.
Article 14 – Governing Law & Disputes
These Terms & Conditions are governed by the laws applicable in New Zealand, unless mandatory consumer protection laws in the consumer’s country of residence provide otherwise.
Any disputes shall be handled by the appropriate courts in New Zealand unless otherwise required by law.
